Partner allegedlly moved out to take advantage of benefits system

    The claimant informed the Jobcentre that her partner had vacated the property so she could claim ESA and Housing Benefit. The benefits officer has refused the claim on the basis that they have only moved the partner out to take advantage of the benefits system. However i cannot find regulations to suggest we can do this. Has anyone else had similar cases to this or know of relevant case law or legislation to suggest we can do this?

    We could do a visit to see if the partner is there as we have our suspicions he probably hasn’t moved out and refuse on that basis.


    This is a question of fact – the partner is either there, or he isn’t. Intent in these circumstances is irrelevant – you assess the claim based on the facts.
