partner from abroad

    Hi
    We have a customer who is currently in receipt of ESA IR – she will be contacting the job centre regarding the following change. Her partner is now residing with her – He is from St Lucia and his visa has expired. He has been placed on a temporary visa as he is currently on bail until he appears at court in January 2011. He is bailed to her address and can not return to where he lived before due to his bail conditions. He is unable to work under the temporary visa.
    Please can you confirm if he is included in the claim or whether he is not included in the claim. Any advice on this would be appreciated – persons from abroad are not our strong point.

    I don’t see how a PFA issue applies here, or for that matter a change to her ESA(IR), based on your post the partner is not a “partner” for benefit purposes because he is resident elswhere.

    If they do confirm he is has formed a partnership with your claimant then that situation changes.
