Payment on two homes for large families

    we have the situation where a neighbouring authority have placed a large family in temporary accomodation with our area, but due to the large size of the family the mother has decided to move herself and the girls to another property in the same street (rented from a private landlord) and the father and the boys remain in the temporary accomodation provided by the LA.
    there are still one family with regard to income and relationships.

    my thought is that it does not satisfy HB 7(6) becuase both are not provided by the LA

    any views?

    It’s possible for two separate buildings to count as one single “dwelling” for HB and CTB purposes. The following authorities may assist:

    SoS v MIAH [2003] EWCA Civ 1111
    R(H ) 5/09
    R(H ) 3/08 (for CTB on two separate buildings counting as one dwelling)
    R(SB) 10/89

    As observed in R(H ) 5/09, any computer system limitations are irrelevant.
