payments to mother/claimant/landord – help

    Hi
    Any advice is appreciated
    We have a customer who has severe alcohol problems and is using his HB money to buy his drink. His mother and landlord have wriiten in to request payments to be made to the mother due to the arrears and certainty of customer not paying the rent. (The mother has brought the rent ip to date and is currently paying the rent for her son) The customer has not given authority to do this but we are sure if paid to him he will not pay his rent. The landlord lives in Dubai and I do not currently have a uk correspondence address for her.
    Question…can we pay direct to mother without sons authorisation
    (mother and son live in separate propeties and do not speak)

    Not as far as I can see. HBR 94(3) makes it clear there must be a written request from the claimant.

    I am aprehensive to send to customer becuase of certainity of not paying his rent.

    I cannot pay landlord as they do not have a curent uk bank account (or agent in uk)

    I cannot pay mother as we do not have any authoridation to do this

    Help?

    I would make a decision to pay the landlord. I’m sure either the mother or the claimant would have the address.

    So how is the mother paying the rent?

    i have been informed by our fraud section that due to the fact that the landlord does not have a uk bank account and does not have a correspondence address for someone within the uk that I cannot pay her

    The existence of a bank account is not relevant. Nothing in benefits legislation requires that anyone must have a bank account in order to receive HB.

    {Edited to add} I’d be intrigued to know the legal basis of the advice from your fraud section. I am unaware of any such provision.

    If the landlord has not provided an address in the UK the tenant may not have to pay any rent at all – section 48 of the Landlord and Tenant Act 1987. See:
