Pension age – War Pensioners and War Disablement Pension

    Is it still the case that for P.A claimants, War Pensions and War Disablement Pension will be taken into account in full (less the £10 disregard) and  such pensioners will NOT tehrefore be protected within the scheme? Or have things moved on?

    I know there was some suggestion that we could locally provide protection through use of S13A(1)c) of the Local Government Finance Act 1992. Is this still the only option?

    My concern with S13A(1) C is that in two tier areas it is the billing authority which picks up the cost in full.

    Any thoughts / updates welcome.



    Wait until the final Regs to find out!


    We’ve included a provision (which will apply to all applicants) disregarding any amount of these pensions not disregarded elsewhere in the scheme. It’s clumbsy and may become redundant but I want to minimise the amount of tinkering required when the Regs are finally confirmed. I think the suggestion by the DCLG that we can only effect this through (c) is plain wrong.
