    I know that we treat a claim from a Pensioner has having been made 12 months prior. But can this be from the date of first contact or only from the receipt date of the form?

    Example
    A 75 year old lady calls on 15th December 2006 to ask for an application form. This is returned on the 4th January 2007. Do we treat her claim as having been made on the 15th December 2005 or the 4th January 2006?

    HB PC reg 64(6d) establishes the date of claim, provided form rec’d within 1 month. The condition for making a claim is therefore satisfied -Reg 64(1) allows you then to go back 12 months.
