Pensioner awarded Relevant Benefit

    Can I have some advice on this – I am beginning to doubt myself.

    Whilst carrying out an Intervention on a Pensioner claim we discover that the customer was awarded Attendance Allowance in 2005 – but she did not notify us.

    The Pension Service did not notify us either.

    I thought we would supersede the award under D&A Reg 7 – because this is an award of a relevant benefit which increases HB/CTB. I thought we would amend the HB/CTB from 2005.

    However, others here believe that we cannot do anything because the Pension Service has never notified us of the award and we cannot supersede until they do??

    Any advice or comments appreciated
