pensioner credit take up partner dies

    Pensioner couple receive HB/CTB. Clmnt dies. Claim cancelled. New claim received by partner but not within the same benefit week so new entitlement would not be continuous as there is no longer a 4 wk linking rule following death of a partner.

    Could the pension credit take on rule be used here so that the new claim for the surviving partner can go back to date the deceased clmnt’s claim ended?

    Or does the fact that the couple already had a claim for HB/CTB prior to the husband’s death mean that the take on rules can not apply for the surviving spouse?

    It’s a new claim for benefit.

    The take-on rule applies.
