Pensioner equalisation

    A current claimant attains the qualifying age for state pension credit on 6.9.10 so the HB/CTB pensioner regulations start to apply from that date. I assume she will be awarded her retirement pension from 6.9.10 and, as this is a relevant benefit, should be taken into account from 6.9.10.

    Our software (Academy) is ‘hard wired’ for pensioner equalisation and in this case takes the retirement pension into account from 13.9.10 together with the pensioner applicable amount.

    Before I contact our software supplier I want to check my interpretation is correct and that the effective date of the changes should be 6.9.10.

    I don’t know Jim, the relevant benefit rule applies where the change leads to an increase in HB/CTB but in this case it would not. So I think your software might be correct.

    Does the lady turn 60 on 6.9.2010? If so she’s one of the lucky people who dont automatically become pensioners on their 60th birthday!
    A16/2009 states that a customer born 6.9.1950 is not traeted as being a pensioner until 6.3.2011 and that March 2011 is the earliest date they can receive pension credit be treated as a pensionerfor hb/ctb purposes.
    Although she is 60 in September, she won’t be eligible for her SRP until the following March.

    Appreciate its not quite what you were asking about……
