Pensioner Savings Credit Claim- LACI received after a month of first contact

    Afternoon All, I apologise if this is a really daft question but I just need someone to confirm that I am on the right track!

    A new customer has claimed Savings Credit and we have received a LACI form claiming for CTB.

    Date of first contact is 05.04.2011
    Date statement issued is 10.06.2011
    Date LACI received by us is 13.06.2011

    The LACI has been received by us outside the month of date of first contact but I still think that we would treat the date of claim as the 05.04.2011 which is the first contact date. This is because the claim is actually made when the telephone call is made to the pension service. The LACI is not sent to us until the Pension Credit claim is assessed so the customer has no direct control over when the form is sent to us.

    It seems a harsh if we would treat the date of claim as the 13.06.2011 as it may be that a Pension Service delay has led to the LACI being sent to us after two months.

    I would be very greatful if someone can confirm that I am going down the right road with this

A claim has been made as it should and the time frame, usually 2 days or a resonable time, as set in the regs is only to do with the DWP. The LACI/LAID should be with the LA within that time frame but nothing else needs to be done by the claimant. So you count back 3 months from April.
