Pensioners in shared accommodation

    I have a pensioner who lives in shared accommodation (own bedroom and shares kitchen / bathroom etc). She is on PCGC and also gets DLA care middle rate.

    When I input her claim on Northgate it wants to base her LHA on the shared rate but I was expecting the system to automatically award a one bedroom rate.

    Is the system right? Because she is renting shared accommodation should she only have the shared rate, regardless of her DLA care?

    I know it's reg 13D but I could do with some re-assurance on understanding it – I think it says that if she is in shared accommodation but has the SDP this would get her the one bed rate.

    If I have correctly understood the reg, why does Northgate not give the one bed rate automatically? (Interestingly, if she had exactly the same circumstances but was under pensionable age, Northgate would automatically pay on the 1 bed rate?).

    I haven’t seen NG correctly do these based on the income. Assessor usually has to override it. In your case DLA is an underlying income because the system sees it as passported. You might have to put a status in but I’m not confident that would work either.

    I have tried applying a severely disabled status but that made no difference.
    I can override the system but it concerns me that I need to do this just because my claimant is a pensioner – if she was under penisonable age and on a passported benefit with DLA care middle Northgate correctly awards the 1 bed rate based on the income.
    This is why I am doubting that I have interpreted the pensioner reg correctly – from your reply though you seem to agree that the 1 bed rate should apply in my case?
    (Pensioners on DLA before they reach pensionable age can keep it although not sure yet might happen with the PIP in the future)!


    we are on Northgate and I’m sure we have to use an override with reason SDP to award 1 bed rate to working age claimants too? it’s been a while since I’ve done one though..
