Pensioners with children

    Is there any provision for pensioners with children who previously claimed Income Support, but who are not eligible for a guaranteed credit, to claim Free School Meals?
    There was provision in the NTC rules for claimants who came off IS and claimed CTC only.

    Because of the following which is taken from Section 201 of the Education Act 2002.

    [i:b035671ab1]A person is within this subsection if-

    (a) his parent is-
    (i) in receipt of income support,
    (ii) in receipt of an income-based jobseeker’s allowance (payable under the Jobseekers Act 1995 (c. 18)),
    (iii) in receipt of support provided under Part 6 of the Immigration and Asylum Act 1999 (c. 33), or
    (iv) in receipt of any other benefit or allowance, or entitled to any tax credit under the Tax Credits Act 2002 (c. 21) or element of such a tax credit, prescribed for the purposes of this paragraph, in such circumstances as may be so prescribed, [/i:b035671ab1]

    I would say the criteria is whether they get CTC and that in most cases they will, however does anyone know if an element of TC has been prescribed and in such circs as prescribed, because if not my children qualify !!!!!!!!


    Presumably the pensioners will be claiming CTC and not working 16 hours p.w and getting WTC?. Entitled to free school meals if the CTC is awarded on an assessed annual income of £13,230 or less (2003 figures). See SI.No 383
