Pensioners with maintenace

    Can some clarfiy the following for me as my head is starting to hurt…

    In this years Zebedee and Ward book it states that if a pensioner receives maintenace the first £15.00 is disregarded. It does not say there has to be the family premium for the disregard to apply (as it would for working age claimants). Is this correct as last years book does not say that. Each book quotes different regs – neither of which seem to say that there is an automatic disregard.

    In the case I am dealing with there are no children to consider – maintenace is purely for the claimant.

    I don’t think there is any difference for 60+ claimants and the need to have the family premium or lone parent premium applies.
    Looking in CPAG, this refers to Schedule 4 paras 13(3) and 47 HB Regs, and Schedule 4A para 20 HB Regs.
    I would look them up for you, but I’m going home – it’s too hot and I’ve had enough, but I hope this helps. 8)
