Person From Abroad – No Income

    We have a case where the claimant has been in the country since 2009 – she is Polish and has not worked a full year.

    The claim was assessed in December on WTX. Claimant had been diagnosed with vreast cancer and undergoing treatment so the claim was based on WTC on the basis that her treatment prevented her from returning back to Poland.

    Information was received to say WTC ceased in March as her employment ended due to her illness. The claim was cancelled from this date, but customer has disputed this requesting an assessment on no income. She has advsied that she is still undergoing treatment. DLA/ESA have been refused and she is currently appealing DLA decision.

    Can anyone please advise – can we assess on nil income?

    If she had completed a year she could have been treated as an EEA that gave up work after temp/permanent incapacity but from wht you have posted that can’t apply. I think you have to supercede ebtitlement from the date registered employment ended and can’t see a way round it. Shame 🙁 Does she have a child in education or any children even if not in education?
