    Hi

    We have a claim where the claimant was born in Estonia. Should be simple but he has provided a letter from UK Border Agency that in Jan 2011 he was person with Unspecified nationality, who was likely to be detained and had to report monthly to police station, which suggests that he could be an asylum seeker or refugee.

    He has now provided a permanent residence card dated July 2012 which still states he is a person of unspecified nationality . He is working and not restricted from working or activities in the UK and has a Lithuanian partner who is not working, but no other docs.

    Are we able to pay HB/CTB on a person with unspecified nationality as we have never seen this on a document before.

    any help would be appreciated.

    ps – It now appears that he was born in Russia but refused Estonian Citizenship when the Soviet Union broke up.
    He surrendered his passport (assuming it is an Alien) to the UK authorities stating he wanted to remain in UK and wanted citizenship or residence. Following several court cases he has been given permanent residence. He has no passport as he did not want it back.

    Can you describe the residence document in detail please? In particular it will help to know whether it is an EEA family member card or a UK immigration status document conferring indefinite leave to remain (that would be better). You normally see these documents issued to non-EEA nationals who have been recognised as refugees or granted humanitarian protection or leave outside the rules and who either do not have a passport from their country of origin or would be in danger if they travelled on their old passport. Does it say “immigration status document” on the front cover, and does it then have a page headed “personal details” plus a photo page where the type of permission is specified? If so, what are the exact words on the photo page?

    Hi Peter

    The document provided is Immigration Status Document, with Personal details page giving place of birth Estonia and nationality unspecified.

    It is a photo id Residence Document and has a passport style number in right hand corner. The type of document states Permanent Residence Card. Remarks state no restriction on holders activity in UK.

    There is nothing about Indefinite Leave to Remain etc, but does Permanent Residence equate to the same thing?

    Right, I think we have got this one nailed. It is an EEA family member residence card – apparently they use the ISD document for them too if they don’t have a passport.

    Because it is a permanent residence card, you don’t have to worry any more about whether the Lithuanian is economically active and whether they are sill married/in an enduring relationship – the permanent card does the job.
