    Help needed please!!! We have a Portugese gentleman who came into the UK on 18.05.04. He originally worked 3 days per week until he became ill. He claimed Income Support on 05.04.06 and we have paid Housing Benefit based on either Income Support or Job Seekers Allowance Income Based ever since. We have now received information that his Job Seekers Allowance has ended on 27.03.08 as he has a sick note from the doctor for 6 months. He applied for Income Support but this has been refused due to him being a person from abroad and not having right to reside for benefit purposes in the UK. He is not entitled to Incap as he has not paid enough contributions. With the illness claimant has it would be unlikely that he will work again. Am I correct to cancel his claim to the 31 March 2008, no recourse to public funds as not ecconomically active? Any advise would be appreciated. Thank you.
