Polish National here since 2002

    Was wondering if anyone could help with this query:

    I have a Polish National who has been here working since 2002 and they have been working,albeit with different employers throughout this period.

    They then have periods of unemployment, during 2007 and again this year, do I still have to look at self sufficency or does them being here prior to 30 April 2004 exempt them from this process. I assume that has the guidance makes not mention of any exemptions that I should be looking at self sufficency.

    If the person has been here 5 years legally then no need to treat them as PFA as they have an automatic right to reside. I would think you would class them as Habitually Resident by now also 😉
    So the question here may be – have they been here legally since they arrived? 8)

    thanks Jon,

    Although they has now been here for more then 5 years, when they were first unemployed it was just short (by a matter of 2 months) of the 5 years
