Polish Worker – Claimed JSA

    I think i know the answer to my question but i just wonder what others did in this situation.

    Claimant is Polish and his employment has now ended. He has claimed JSA but this hasn’t been processed yet.

    Because he has registered as a jobseeker would you pay the claim on NIL income, or do you have to wait until JSA has been processed and awarded before you can pay the claim.

    I think the claim can be paid on NIL income due to the fact everything i have seen states they have to register as a jobseeker, which he has done.


    If he satisfies the rest of the conditions for R2R, he has kept “worker” status, then you don’t have to wait for the JSA award. I would pay on his current circumstances and maybe add on JSA as a notional income[In case its a contributions based award he gets].


    Kay is right, but I would tread carefully and the only question I would ask is…what will you do if you have set the claim up based on nil income only to find that JSA is refused as your clmt fails the HRT with JCP???
