Poor decision by DWP

    Have a customer who we have previously refused HB due to being treated as a PFA.

    We then get a new claim based upon JSA(IB) – wonderful we think – finally got his status sorted. Quick check with DWP and basically they have awarded JSA(IB) and asked him to provide evidence of his immigration status.

    We were at that time in contact with Ursula about some of the odd decisions we are seeing and flag this one up. She contacts our local office and JSA ends with instructions not to make a further award until immigration status has been proven. However this cancellation is not retrospective so the system still shows a period of entitlement.

    Given that the DWP are aware of what we are aware off and probably did not cancel back as it would have been their error anyway are we obliged to pay for this period too?

    Hope this thread helps but I am of the opinion that if there has not been a proper JSA, I/S award and thie entitlement was due to DWP error then claimant is still a PFA and is not exempy under an incorrect JSa or I/S award.
