Prior Residence Order – Close Relative

    Morning all.

    I have a case where the clt is renting a room from someone who once had a residence order for her.  The relationship only came to light when checking the landlords details for another reason when we noted that our clt had been helping him with a housing application and calling herself his daughter.

     

    A decision was made not to pay HB due to close relative rules and now clt has came to us to say she is not actually his daughter he only had a residence order following the death of her mother. 

     

    I am thinking that there is no close relative connection hear and everything else being well we should pay, any thoughts please?

    Good question.

    In the landlords housing application she has advised them she is helping him with the forms etc because she is his daughter. However she is telling us there is no relationship, he was a friend of her mothers who took her on when her mother died until she was 18. She is now 27 and been at a few differnt addresses in our area and other areas since she was 18.

    Have you asked for a copy of the residence order?

    yes and she has supplied some of it, but tells me she doesnt have all the pages. The page that would hold the reason for it being granted is missing, are duplicates available?

    If i get this and this shows no relationship that would count as close relative i assume she wouldnt fall foul of that rule?

    No, I don’t think she would. Non-commercial seems the route to go down if I was you.

    Non-commercial is another option, wanted to clear up the close relative thing at the same time.

    As far as I am aware the close relative relationship ends on divorce or death etc so it wouldn’t apply in this case.
