Private Foster Care

    We have a case where a 16 year old is receiving private foster care from one of our claimants.
    Our claimant receives CTC and has applied for CB.
    Regulations say that we do not include foster children in the claim (nor authorise Free School Meals) but is this case different as the claimant does not appear to receive Fostering Allowance?

    i.e. We should include the 16 year old as a dependant on the claim and CTC/CB plus authorise a Free School Meals

    If the person has not been placed with the claimant by the LA or a voluntary organisation under powers conferred by S23(2)(a) or S59(1)(a) of the Children Act 1989, and the arrangement is a completely private arrangement , the person should be considered to be a member of the houshold and the applicable amount increased accordingly.

    The same will apply to free school meals.
