PT work and a student PFA

    Please can someone give me some advice on this – 😕

    A lone parent from Slovenia been here for 4 years 4 months, has worked and claimed HB on off the whole time now has started a Bio medical Science course but is still working 16 hrs per week.

    Advice from DWP is that she is a student and should be self sufficient, however some people here think we should class her as a worker as this ‘trumps’ all?

    We have denied her HBCTB app as per the DWP advice, she has asked for a revision.

    She claims WTC and CTC and has a student grant if this info helps?

    Personnally I would ignore the DWP and pay her as a worker. She satisfies the conditions and passes the HRT so is eligible, and is also an eligible student.

    I may have got this very wrong, but I thought as a student she would have to be sef sufficient? So would not be eligable?

    This is why i was so stuck becuase as a worker she is fine but the student part really put a spaner in the works!

    As i say i may have this very wrong as i do not do PFA very often!

    She is a student and a worker. So in my opinion would be eligible as she satisfies 10(3B)(a) as a worker. If they are eligible in one way, I cant see that they have to be eligible in both. You could always advise her to get some medical insurance if you wanted to cover all the bases.
