PTD appeals

    Help!

    We have a situation where the customer submitted a PTD to us on 14/02/2007, the Rent Service responded on 16/02/07, the tenancy started on 20/02/07 on the same day the claimant appelled against the decision, the clmt moved into the proposed property on 22/02/07, but we haven’t been able to fully process the claim, due to pending information. Can the claimant appeal against the PTD decision? I thought the whole purpose of the scheme was to advise clmt’s of their maximum entitlement before they decide to take on the tenancy. If there is a right of appeal, which reg does it come under as I cannot find any reference in the CPAG books?

    The claimant doesn’t have a direct right of appeal against the Rent Officer’s determinations, they have to do this indirectly by appealing the decision on their HB award. So you can’t actually request a redetermination on the claimant’s behalf until you have finalised the benefit decision.
