Question of identity

    I have an interesting case where a claim form from a French national who has resided here since 1971 has been received in the name of SF with a d.o.b. of 2.9.47. The NINO provided on form when checked belongs to DD with a d.o.b. of 13.8.43. When asked to explain this, clmt said when he came to UK his employer asked him to change his name by deed poll (documents to prove this no longer available)and then applied for a NINO on his behalf but used the wrong date of birth.

    Throughout his working life here, he has made contributions in the name of DD, his P60, NHS medical card and employment related paperwork all refer to DD with a d.o.b of 13.8.43.

    In 2005, he was issued with a new French passport in the name of SF with a d.o.b. of 2.9.47. He evidently still considers himself to be SF and I have sent a DCI 1 for a NINO.

    I know for purposes of SSAA I have done what’s required and could put the claim into payment but I’m uneasy about doing this due to the identity issue. I can’t understand how a NINO with a different date of birth was obtained. Surely some sort of documentation must have been provided at the time the NINO was requested to establish his identity?

    Any thoughts?

    There was some guidance or fraud circular issued in the last year or two regarding fake French documents. will have a look for it!
