RECOVERING HB DEBTS VIA ATTACHMENTS OF EARNINGS

    Can anyone help, i’ve been asked to post the following question: –

    What we want to do are attachments of earning in respect of a HB debt once a civil debt judgement has been granted in a county court.

    We do not know which HB legislation to quote when sending out attachment requests. For council tax it is covered in schedule 4 of the Local Government Finance Act 2006.

    Has anyone got any ideas.

    I thought the courts administered the AEO rather than yourselves (under the Attachment of Earnings Act 1971.)

    HB Overpayment, court order granted for an AOE. If the AOE stops as the claimant reclaims so we deduct from ongoing entitlement, then their entitlement ends and there is still an overpayment we can go straight to an AOE I assume. If we are asking for their new employment details what powers do we have to make them give us the details or do we have to go back to court to get the info? Thanks in advance.
