refusal to refund?

    Hi

    An authority I won’t name are refusing to give a refund on an account of a person who has just had full ctb awarded – the reason given is that their circumstances might change.

    Does anyone know if this is lawful practice – the money was paid due to a direct debit going through late and is rightfully the claimant’s. Having recently started on IS, they could do with having the money back!

    Any advice much appreciated.

    I have heard of a similar practise a long long time ago…….

    However, you mentioned the fact that they are in credit due to a direct debit payment coming out late. If that’s the case, is there scope for getting a refund from the bank through the Direct Debit Indemnity scheme?

    That should get the payment straight back into the claimant’s bank account and the council would have to repay the bank.
