    Just need some re-assurance that this regulation means that we cannot take into account the amount of a Reduced Benefit Decision made by the DWP, rather than no DHP can be made at all because a RBD is in place. The phrase “does not arise as a consequence of” could be interpreted both ways.

    From my IRRV notes and understanding –

    Reg 3 covers the situation where a DHP cannot be paid. This includes a case where a benefit has been reduced /suspended (for whatever reasons). I take this to mean that, if JSA is reduced by 25% (purely an example) no DHP can be awarded to cover that reduction. Therefore if already in receipt of a DHP it can’t be increased. If this were the sole reason for a DHP request then it could not be paid.

    Thanks for the reply Mark. It’s as I tghought, but never having had a DHP request with a RBD before, I just wanted to make sure.
