Can anyone please clarify whether Incapacity benefit is included in the relevant benefit list.
I have a claim which was based on short term high rate. In March 09, we discovered that the long term rate became payable from January 09, so the assessor amended the claim from March using late notification rules as it was a beneficial change. I think we should have gone back to the January when the change actually occurred. Help please!

Section 8 of the SSA 1998 lists the relevant benefits and the first category is [i:23129f641e]”Benefit under parts II to IV of the Contributions and Benefits Act”[/i:23129f641e], which I believe includes Incapacity Benefit.
