Rent Deposit and LHA

    We have a few organisations that are trying to get people housed and make use of the rent deposit scheme. Are there any special rules when it comes to LHA and rent deposit schemes that anyone knows of?

    Our LA plus a number of neighbouring LA’s have this scheme and are all asking if there is anyway of attaching direct payments to LL in as part of the the deal which I guess in theory will make it a more desireable scheme for LL’s.

    As far as I am aware there is nothing in the LHA regs to support this. I think the same query applies to PSL tenancies/arrangements.

    I think it would be unlawful to do so. Such arrangements are agreed irrespective of the claimant whereas the regs will only allow individual decisions to pay the landlord.

    What if the claimant appeals? What does the LA do? Admit it ignored the law for its own reasons?

    I am not saying I agree with the policy as I can understand the impact on homeless provision.

    Run a bond scheme, not a deposit scheme. By law there is now little difference anyway as Landlords must enure safe keeping of deposits. No money passes hands, unless you do get a troublesome tenant AND to ensure that the Bond Scheme gets respect, make sure that any real money, once agreed is paid promptly.
