Rent Increases and LHA

    We have a claimant who currently receives maximum LHA plus £15 top up.

    LL has increased the rent slightly, however the charge is still under the LHA rate therefore £15 top up would still apply.

    I can’t see anything in the regs allowing me to make these changes and award more benefit. Do I just have to wait until the ANN date or is there some provision in the regs which covers this?

    Although it is clear that the maximum LHA can not change where there is an increase in rent (midyear) I also can not find anything in the regs to cover not changing the split between the core and excess rent – the DWP guidance is that the rent increase is ignored but if the real excess is reduced through a rent increase the entitlement should reflect this?

    Hi. That’s my understanding too – once decided the TOTAL amount payable is fixed until the anniversary (or a change to the number of rooms required), but the SPLIT (ie where any excess is paid to the LL) should be redecided if the rent changes.

    I have been advised that there is a problem with the Academy system is re-apportoning the split so was going to contact them. Do you use Acadmey?
