    Can anyone settle a dispute,

    If a new claim is paid on indicative rent level, and the R/o decision comes back lower than the indicative. Should we:

    1) input decision from the Monday following decision? or

    2) input decision from start of claim and make o/p irrecoverable?

    Would there be any subsidy problem with either method?

    Any relevant regs would also be appreciated.

    Option 3. Basing entitlment on an IRL is a payment on account under HB Reg 93(1)(b). The overpayment is recoverable.

    …and you should already have warned the claimant this might happen when you made the payment on account (Reg 93(2)).
