Rent payment frequancy

    Hi. Claimant has a pre 07/10/96 claim which is paid hb 2 weeks in advance and 2 weeks in arrears. He then requests that we pay the landlord. Does the payment frequency remain the same or change to 4 weeks in arrears?

    If payment is switched to the landlord they retain their pre Oct 96 protection and payment remains to be made “2 weeks before the end of the period in respect of which it is made”.

    The relevant provision is the modifications made to HB Reg 92 (or HB Pensioners Reg 73) by Sch 3 para 7 of the HB/CTB Consequential Provisions Regs 2006.
