    Does anyone know of any case law or Commissioners decision regarding the 13 week exemption from a ‘maximum rent’?

    We have refused to award a claimant the relevant exemption as we are not satisifed he could meet the financial commitments of the property when he moved in. Claimant has appealed and I was wondering whether this issue had ever been considered by a Commissioner.

    It has actually been considered by the Court of Appeal in Secretary of State v Julien CA 2.4.92. The case is reported as R(IS)13/92.

    Those who are old enough and/or whose memories are long enough may recall that there was outrage in the tabloids over this one at the time
