    Claimant has been housing by our adult support team in 3 bedroom property and rent is £132 per week. she has carer who stays with her overnight, she was previously in care home.

    the tenancy is with the council adult support team. previously she was in similar situation,before going in  to care home, and we had assessed the tenancy as hb  pten ha.we have now set new tenancy as drt but i am having doubts now as the previous claim was ha.

    i guess the bottom line may be we assessed incorrectly in the past or should the new claim be  ha but i cannot see how it could ha to be honest.

    Who is the landlord? (i.e. to whom is your claimant liable to pay rent?)

    the landlord is actual the council social services. looking on the notes the actual owner is bournville vt who are ha but be we sub let for use for people with disablities.

    On that basis (assuming when you say “the council” you mean the same council as you awarding the HB) it should be non-HRA!
    Alternatively (and quite possibly) the soc services dept may simply be acting as agents – in which case it would be HA.
    The key is whether the council have leased the property from Bournville.
