Renting off former partner

    I have a father who has recently gained a Parental Responsibility order for his 4 children as his ex partner has abandoned the children and set up home with another man.
    The house is owned by the ex partner and she is charging them £1200.00 per month rent. The father has never owned the property.
    The father has live alone there since 25/01/09 but before this period they lived as a couple from 23/11/07- 01/04/2008. But from 05/07/2008-16/10/200/ his ex-partner lived there alone, it seems the father moved out for this period.
    Would you pay HB, or if you say no which reg would you use for refusal. [/b]

    Try these – d) is the obvious one:

    9. Circumstances in which a person is to be treated as not liable to make payments in respect of a dwelling
    (1) A person who is liable to make payments in respect of a dwelling shall be treated as if he were not so liable where—
    (c) his liability under the agreement is—
    (i) to his former partner and is in respect of a dwelling which he and his former partner occupied before they ceased to be partners; or
    (ii) to his partner´s former partner and is in respect of a dwelling which his partner and his partner´s former partner occupied before they ceased to be partners;
    (d) he is responsible, or his partner is responsible, for a child of the person to whom he is liable under the agreement;
