Residency payments

    We have a customer who receives residency payments for her grand-daughters since January 2044. We are aware these are now fully disregarded as per circular A19/2010, but as she is a pensioner the ciruclar indicates they should’ve always been disregarded. If this is the case does anybody know when this came into effect and the regulation that covers it.

    This is one of those reverse logic scenarios. In the working age regs, the starting point is that all income counts UNLESS expressly disregarded or treated as something else.

    In the “pension age” regs, it’s the other way around. The starting point is that nothing counts as income UNLESS it is expressly listed as an income. I haven’t checked earlier versions of HB(PC)R 29, but I’d be surprised if Residency Order payments were listed as payments. If they were not listed, they could not count as income for the pension age regs.
