Responsibilty for a landlords child

    We have a claim we are looking at whether we can pay housing benefit – it is a new claim made at the end of April 2010

    Clmt 18 years old, partner 15 years old and she is the child of the landlord.

    In this scenario who has responsibilty for the child?

    We know that the landlord received a dependant addtion and family premium on his IS until the end of April 2010 but do not know who received the child benefit.

    The landlord. I don’t think a 15 year old can be a “partner” in any circumstance under UK law.

    Be very careful.

    There was a case I heard of some years ago where an under 16 was treated as the partner.

    The LA concerned got a bit of a telling off as she was below the age of consent.
