    Morning
    Could anyone help me?
I am wanting to make a decision to restrict an unreasonable rent increase as the increase has been proposed after only 6 months from the previous rent increase. In breif, what reg do I quote in my decision?

    Thank you

Well, HBR 12(B)(6)? That’s if the rent increase can’t be considered under HBR 14(1), sch 2, para 2 as a relevant change of circs!

The increase in question applies to an exempt accomodation case and we have gone with a decision to refuse the rent increase under HB and CTB(Consequential provisions) Regulations 2006 in particular Reg 13ZA(1)(b). We have had an immediate request for a reconsideration.

Has anyone been in this position before?

    Relevant case law:

    [b:00f50c9579]CH/2214/2003
    CH/2036/2008[/b:00f50c9579]

Some aspects considered in CH/2214/2003 were not necessarily followed in the latter decision.
