Retrospective Rent Officer’s Determinations

    Good morning all,

    Does anyone know if there is any rule or law regarding using a rent officer’s decision for a previous period.

    Rent Service descisions are based on current market data – in some cases a new decision for an old period will benefit, in others it will disadvantage. How old is the period?

    Hi Sean,

    Thank you for your reply. We have found another way round the problem that we had and no longer need to backdate the decisions.

    Through trawling guidance I couldn’t see anything apart from the Rent Officer refusing to give us a backdated decision to stop us but did stop looking as someone else came up with a better solution.

    Just a reminder of what the Rent Service said to HBINFO on this point:

    “The policy TRS is working to is that we should accept referrals up to 31 May for the fiscal year prior, as the report says. Anything that misses that date we would deal with as a “delayed referral”. This would mean that the TRS office would provide a decision but it would be a non-statutory one and would be completed as a separate entity to that of a standard referral decision. There are special occasions where we would provide a statutory decision and these would be in circumstances that are extenuating.

    The message that TRS try to get across to all LAs is simply to make the referral as soon as is possible regardless as to whether HB will be paid – this enables the RO to provide a valid decision thus covering the LA from the beginning of any claim”.
