Romanian ex-self employed

    Hi

    Any advice would be appreciated on the following case-

    We have a claim in from a Romanian couple – entered the country in Jan 2011 with 1 child. They have claimed on 12.7.2011 stating that he was self employed however he no longer works. Mrs has a Nino but Mr was refused as he had failed to provide sufficient evidence of the Right To work. The only income they have is Child Benefit and money from relatives.

    Are we right in refusing the claim?

    Based on details you have posted, yes. Forget the NINO requirement, they have not even got to the “pass go” stage. Unless they satisfy conditions of an EEA family member/extended family member?

    Well, unless they are self-sufficient and satisfy the rest of those conditions, they have no right to reside.
