Hi – can anyone help – 2 caravans on one plot all owned by Mr B. he occupies one caravan, His sister occupies the other. HB has been refused under close rel/sam dwelling. There was a case some time ago re a caravan in a garden but can’t remeber which way it went and now have loads of cases to trawl through on the commissioners website!

The general rule is that if you are not sharing any part of the accomodation you are ‘residing in’ the same dwelling, so for example if he owned a house and she had a self contained flat she would not be ineligible as a close relative.

In this case she (presumably) has her own accomodation so is not excluded as a close relative under Reg 9

Annual income twenty pounds, annual expenditure nineteen nineteen and six, result happiness. Annual income twenty pounds, annual expenditure twenty pounds ought and six, result misery. The blossom is blighted, the leaf is withered, the god of day goes down upon the dreary scene, and—and in short you are for ever floored.
