    Hi All,

has anyone come across any guidance/legislation that states that a client must have lived in qualifying accommodation within a certain number of years for the exemption to be applied.

Fro example Mr B is aged 33 and lived in qualfying accommodation when he was aged 18 for four months. Is there anything that says that because this was 15 years ago (or however many years ago) that the exemption would not be applied?

I've just come across murmurings of this within an LA I have dealings with.

    Thanks

No limits at all, and it also doesn’t have to be consecutive – it could be 1 day a month, for every month for the last 10 years and they’d qualify for it!

    Hi

thanks for your reply. It was my understanding that there were no time limits around this so I am a bit concered that this is being bandied about a HB dept but it would be easily challenged I think.

    Thanks

Perhaps they have set a limit, as they are not comfortable verifying information from so far back, but there’s no reason to really.
