self employed non worker (polish)

    Hi

    I have a self employed polish national who is self employed. He has been here since 2005 and has proper audited accounts etc and has been earning £25000+.

    He has now put a claim in to us on the basis that he has not had any work since beginning of October 2008 and has no income. Do we still treat him as self employed , but use nil income. Do we treat him as a work seeker although I don’t think he has registered yet with Job Centre, who does not need to be registered with Home Office for work.

    I would be grateful for any help as I have not had self employed foreign national who is not working before.

    What type of self employment is it?
    Is it subject to seasonal variations?
    Has he informed Inland Revenue that he is no longer trading?

    He is all above board with the self employment and he is in the building trade. He has not stopped self employment he just has no work, which is why I am stumped.

    For PFA’s they dont need to actually be doing any self-employed work, just have the intention of being self-employed so he would be ok.
