Sentenced prisoner making a new claim

    Hi, I have a new claim from a customer who is currently serving a sentence of 11 weeks and 2 days – starting 09/10/12. Clm form was requested on the 15/11/12 and returned 29/11/12.

    Can I pay this – I am struggling with the fact that she is already serving her sentence – she went straight back to prison without being on remand. Although the absence will be less than 13 weeks there is no live claim so I cant treat this as a change in cirs…


    The temporary absence rules are in no way reliant on the person having a live HB claim, they simply outline the situations that allow you to treat someone as occupying their home when they are not.

    So as long as they fall into temp absence rules, you treat any application received in exactly the same way as you would if they where actually living at the property.
