Severe Disability Premium & non-dependant couple

    Can anyone help with this query? The claimant gets Attendance Allowance and no-one gets carer's allowance for looking after her, but she has a non-dependant couple living with her (her daughter and son-in-law). Her daughter gets Attendance Allowance for herself but her son-in-law doesn't – he works. Should she get a Severe Disability Premium on the basis that the non-dependants are a couple, so their income is looked at jointly and as one of them is in receipt of AA they are ignored for SDP purposes? Or does the fact that the son-in-law works and doesn't get AA himself mean no entitlement to the SDP?

    I don’t think she gets the SDP as there is a non-dep who isn’t iro AA, although his partner is

    Thanks for your reply. That was our initial thoughts but our system is wanting to award the SDP!!
