Severe Disabilty Premium & carer premium

    My colleague is dealing with a claim at the moment, where both claimant and partner are in receipt of DLA3 and have underlying entitlement to carer’s allowance. The partner is not pension age and the claimant is. We are currently awarding 2 SDP’s and 1 carer premium. There is a bit of confusion as to whether this is right, should they get the SDP’s if they get carer’s allowance?

    The SDP is only affected if Carer’s Allowance is actually in payment. If there is simply an underlying entitlement to Carer’s Allowance, then the SDP remains payable.

    Thank you for replying. So in this instance, they should have both the SDP and carer premium. We’re having a bit of a fog brain day today.
