Shared Carer??

    Good Afternoon everyone,

    We have a property that is let as a HMO, 5 bedsits, shared kitchen and living area.

    We have just dealt with a claim for a young individual who qualifies for an SDP. He is entitled to a 1 bedroom LHA rate. However, he does have a carer who stays overnight so will qualify for an extra room for him – he now qualifies for a 2 bedroom LHA rate. So far so good ?

    We have now received a claim form another young individual who qualifies for an SDP. He shares the same carer as the the first claimant so my understanding is that he will also be entitled to a 2 bedroom LHA rate?

    Any thoughts?

    If they are bedsits, do any of them have a ‘spare bedroom not used by anyone else in the household’ because they need it to get the extra room?

    Yes they do, sorry I should have explained this. We think that the landlord is planning to let 4 of the bedsits and leave one of a carer to be shared by each of the other 4 tenants?

    Okay… but doesn’t that mean that none of them have their own spare bedroom – isn’t it effectively just another unit in the same building that is (or can be) let to the carer?

    the DWP have recently clarified to us that in a case we have, where the landlord is also the company providing 24 hour carers to three or four residents, and the carers do not sleep at the property (they’re there overnight but they’re awake, working, not sleeping) and the carers’ room is used as an office rather than a bedroom, the extra room provision does not apply

    this may not help you with your case though!

    Hi,

    I agree with you that they should be given the 2 bed rate assuming they meet all the other criteria. From what i understand as long as there is a bedroom in that dwelling and that it is used as a bedroom for an overnight carer to stay ( on a ‘regular’ basis ) they would qualify for the additional room
