Should Interest be paid

    Hi

    Does anyone have any thoughts on this recent newspaper article. Someone had written to a Lawyer here who has a column in the paper. They explained that their property had previously been banded incorrectly (too high) for 14 years. It was then rebanded downwards and the LA issued a refund of the difference.
    The customer then asked the LA if they would be paying interested on the money – amount estimated at around £450.00 but the LA said that they would not pay interest. The customer asked the Lawyer if matter worth pursuing.

    The Lawyer advised customer to write to LA to ask for “their legal justification for not paying interest”

    does anyone know what answer a LA would give in a case like this if they were challenged in this way?

    The legal justification is that, unlike NNDR, there is no provision for interest to be paid on overpaid CTax due to a banding reduction in the CTax legislation.

    Hi

    Following on from this post, we now have a taxpayer wishing to take the LA (not the VOA) through the County Court for payment of interest. is anyone aware of any other such cases as this and if so, what the outcome was?
