SMI DISCOUNT

    We own a property which is a House in Multiple Occupation for council tax purposes – it’s a special project shared housing scheme where all the residents are severely mentally impaired. (There are no resident staff).

    I appreciate that the property is not exempt – because we as the owner are liable – but as I understand it it should attract a 50% discount. However, the local authority is saying that a discount cannot apply.

    Are they right? If so, can anyone explain why?

    If all the residents are SMI (and each would have to be separately verified as such) then the property does indeed attract a 50% discount.

    Is your LA operating a reduced discount for long term empty properties? Do they think this is one?

    Thanks for this – I thought as much!

    No, the authority is well aware it’s a supported housing scheme solely occupied by SMI residents. I can’t think what they are playing at.

    Isn’t the property exempt from CTAX charge if all residents are SMI ?

    No – it would only be exempt if the occupiers themselves were liable.

    Bob is right. The exemption only applies if the SMI people themselves would be liable but for the exemption. Care homes etc do not qualify for the exemption because the owner is liable rather than the residents.
