HB regulation (7(8)(c)(ii) allows for HB to be paid on a dwelling prior to the customer moving in:

as long as the move was delayed pending the outcome of a claim for a Social Fund payment to help with the move or with setting up home and,

The delay in moving is reasonable and

they have reached pension credit age or have a child aged under 6 or someone in the family is disabled in one of the ways relevant to a disability or disabled child premium

I wondered if anyone has any idea as to whether this regulation will be amended to reflect the new Local Assistance scheme that Local Authorities are in the process of designing for April 2013, thanks.

    Hi Julie

This link was included in the last edition of HB Direct.

    http://www.legislation.gov.uk/uksi/2013/443/made

and relates to ‘Claimants who are delayed moving into a new tenancy following an application for local welfare provision can receive payments for any housing costs for which they would be entitled to at the new address, for up to four weeks prior to moving in.’

Quick revival of this thread to ask if anyone knows whether this SI was mentioned in any circular around March / April?
